Why a guaranteed rent company is not a tenant
The agreement we sign is a commercial lease, not an assured shorthold tenancy. That single difference changes who carries the void and who fixes the boiler.
Most landlords hear "we'll rent your house from you" and picture a tenant. It is a fair assumption and it is wrong, because the paperwork underneath is a different instrument entirely.
Different contract, different law
An assured shorthold tenancy under the Housing Act 1988 requires an individual occupying a dwelling as their only or principal home. Quaysure Homes is a company; we do not live in the property. What we sign is a company let — a commercial lease granting us the right to occupy and to sub-let. The Housing Act protections for tenants do not attach to us, which is why possession is a contractual matter between two businesses rather than a court process against a resident.
Who carries the void
With an AST, the rent stops when the tenant leaves. The landlord pays the mortgage, the council tax, the standing charges and the re-let fee out of their own pocket until someone new signs. With a company lease, the rent is owed by us for the whole term whether the house is full, half full or empty. The void risk moves off your balance sheet and onto ours. That is the product — everything else is detail.
Who fixes the boiler
The landlord keeps the statutory obligations that cannot be contracted away: the structure and exterior, the installations for water, gas, electricity and heating, gas safety certification, electrical installation condition reporting. We take on everything day-to-day inside that boundary.
- Callouts, minor repairs and consumables — ours, up to an agreed per-incident threshold.
- Cleaning, linen, garden and gutters — ours, on a schedule, not on request.
- Boiler service and annual gas safety — arranged by us, invoiced to you, so it never lapses.
- Structural, roof, subsidence, major plant replacement — yours, as it would be with any tenant.
What you give up
Control over who occupies it, week to week. You will not vet each guest, because there is no single guest — a house might hold an insurance placement for four months, then a site team, then a family for a fortnight. If you want to approve individual occupants, guaranteed rent is the wrong model for you and we will say so at the assessment rather than three months in.
